Dear Friends,
I spend about 50hrs a week to maintain my real audio site. Besides I spend lot of $$$s or RS.. on collecting songs - Raja/Msv/Ar etc.
Besides I have a huge carnatic collection,
But site like Mail-Bag.com, a commerical site makes a direct link - misuses my Real audio files without my permission, when asked they reply in a bad way, .
I was shocked to see all my songs were directly pointed and being used.
This is ridiculeous - I spend my time and money to make my site popular and these guys steal the link and claim they have most number of songs.
It is like entering into my house and stealing my house articles.
At this rate I will be forced to close my site ,
due the maintainence - I keep renaming my files and other techs;
Please do not do a link poching , small timers like me have web site just for the love towards tamil music, and don't force people like us to close .
Guys someone do something to stop this poching.
I asked Ravi about this - but I dont know for what reason that question has been removed by him

I think one way to avoid this can be by renaming the audio files frequently.

Thanks for the Idead, But I have been doing this and it is a big pain, I waste lot of time on this.
Rather I would spend on adding new songs.
I have decided to code a tool that prevents this.

Are'nt the guys in Mail-Bag liable to be sued for copyright violation ? I'm not suggesting that you should do this, but I'm just wondering if people can get away with poaching. This, I agree, is a serious problem that needs to be tackled firmly. I think Manisekaran had mentioned in the thread on MKTB about him working on copyrights and IPR. Perhaps he'll be in a position to advise you of a way.

I spoke to few producers in Madras regarding copy rights, the FM programs broadcast them without any permission, as this make the songs popular, the producers are not much worried, so for me they told me as far you are not able to record and distribute it is ok to put the songs in mweb site.
But more than that I spend around 70hrs on recording, editing etc but someone steals the links and puts it on thier site.
Also mail-bag is a commercial site,
I wrote them a email,
this is what he replied to me

from Kangalin Vaarthaigal). I don't really know why you are so upset about this. I am
maintaining lots of songs from our server, and I know that there are lots of people
providing direct links to those songs. For us the bandwidth used by those other
accesses cost money. Inspite of it we don't care about that because this site is
mostly to promote thamizh film music. As you know we don't even have mail order
services.
And in your case you are maintaining your site out of Xoom which is a free service,
and there is no bandwidth limitation. Also every other thamizh music site is violating
the copyright laws. Did you think about that when you sent the mail to us.

This is does not justify your action .
I had spoken to few people in Madras about this. As far as it is not
commercial - the songs can be used.
There are many advertisments in your page and your are using it
commercially.
Regarding the links - Many msv songs have also been linked.

I have also paid for the real audio encoders, spend about 80hrs a week on
maintaining this
Atleast I expect you to inform me when you use my link in your site. or
atleast give a reference about my site.

Then book free space in Xoom- sit and record all the songs, spend time in
uploading the files,
who will come into your way --- is Xoom restricting you ---- >

I undersatnd your problem and empathize with it, but I do not think there can be anything done. Suppose you had written an article in a magazine, and someone else took passages without crediting you, that is an offence. However, your site has songs by composed by other people, and therefore can be linked to by other sites.
The internet is a public domain, unlike a magazine (where you need permission to reprint aricles), and linking cannot be considered an offence. Of course, decency demands that the person who links to your site credits that as being your work.
It's like the average Pink Floyd Fan who makes a home page and then links to someone else's Floyd site under his "interests" category. This sucks, but there's nothing tht can be done. However, you should ask them to credit you at the link.
Otherwise you could something like making your site password-protected, so that everyone is forced to acknowledge you as your site's Dwaarapaalakan :--).

If they gave link to my site - I am fine with it.
They are using my real audio Url directly,
They just call only the real audio song directly.
I hope you understand,
Visit Mail-bag. com and hear few MSV songs, you will find my name in the real audio dialog box.
My concern I spend my time and mony to record and upload and these guys just calls my Real audio URL directly.
You are talking about a link - Internet is made up links - if it going to be a link it ok - you should link my URL to my music channels,
but using the song directly in the music channel is unhealty practise.

Bharat : do you know - how real audio works out
You dont seem to know it.
here it goes -
First I record a song in my computer as a WAV file...then I convert the song to the real audio format using a real audio encoder.
. This real audio file is uploaded (Each song is about 1mb+)
to a URL -
Say http://Xoom.members.com/jsri/raja1.rm
I provide a link to this web page in a Meta file (*.Ram extension) through my web page
That what you click to get the song,
Your browser will bring down the ram file and activate Real player which will stream the ecoded real audio file from the URL in the .Ram file,
(This Ram will contain the Real audio Url -
http://Xoom.members.com/jsri/raja1.rm)
People like MAil-bag steal the URL in the Ram and call them directly from thier site ---
This will also play the .rm file... but I have uploaded this .Rm file to use in my website.
I AM AGAINST THIS .RM files Pouching.

ALSO almost all the songs in Mail-bag is like that- (they claim they have more number of songs - it belongs to others) ,
they are also a commercial site - they cannot do anything without copyrights -
My site is a non-commercial site and I maintain it for my love towards Tamil music.- I have also spoken to few directors regarding this,

I think I have found a solution to your problem, which I will also be implementing for my homepage. But I am afraid the solution to this will depend on the OS your server is using, how YOU are accessing the server etc (either by FTP or directly from Windows Explorer etc.)

Hello.I agree with you about the fact that someone needs to do something aboutthe poaching .However,The main reason that I came to this site is because at school my social studys class is having a trial about poaching and I wanted to find some facts that I could aruge in defence of the 2people who are acuesed of poaching .Well what I wanted to say is that you don't have any facts about people poaching ,and you might on another web page and if you do then you should tell us there names so we can go visit is.

You are perfectly correct. Being a web master myself, I understand the pain you are put to.
I was really feeling bad in the beginning, but
I don't care now. Fellows who poach your songs,
will not have most of their songs working. So they are not going to have visitors. As long as
you maintain a site with less broken links, you are going to have increased traffic.
Thirudaanaai paarthu thirundhavittaal thiruttai olikka mudiyaathu...
My only suggestion is to keep changing the file names but instead spend it on adding new songs.
BTW, I used xoom.com for IR, ARR, Devotional, Carnatic and other songs but moving away from xoom.com. Looks like xoom does not allow unlimited bandwidth. If the page exceeds some counts, they seem to block the site. I had the pain of creating , recreating, uploading and re uploading the songs to xoom but because of their frequent blocking of my sites, I am moving to different servers. So beware. Take measures. Suddenly they may block your site too. So beware. There are few good sites like www.crosswinds.net,
www.stas.net and www.i-drive.com (I have not tried this yet). But the problem is first 2 servers does not allow FTP and that is painful. But they say they allow unlimited bandwidth/space (atleast till they become popular, we are safe).
Continue your good work. I do not know your site.
